AEON-KĄCIK ZEGARKOWY**

§1. General Provisions

  1. The AEON-KĄCIK ZEGARKOWY online store processes orders within Poland and selected countries worldwide.

  2. Free delivery applies to orders shipped within Poland and the European Union.

  3. All prices shown in the store are final retail prices and are listed in Polish zloty (PLN).
    For information regarding price negotiations, please refer to the page “Jak negocjować z nami cenę zegarka?” (“How to negotiate the price of a watch with us?”).


§2. Placing Orders

  1. An order is placed by adding a product to the cart, completing the registration or checkout form, and submitting the order.

  2. An order is accepted for processing once the payment has been successfully received in our account. Due to the payment systems used, this typically takes up to approximately 24 hours from the moment the order is placed. The order processing time is calculated from that moment.

  3. Any order that is not paid for will be cancelled.

  4. The store reserves the right to cancel or refuse to process orders that are:
    a) not paid within the required time,
    b) placed using false or fictitious personal details,
    c) raising justified doubts regarding authenticity,
    d) repeatedly placed and left unpaid by the same customer.

  5. The store may refuse to process future orders from individuals who have previously abused purchasing procedures or repeatedly placed unpaid orders. The IP address from which such repeated unpaid orders were submitted may be blocked by the store’s system.


§3. Payments and Delivery

  1. Available payment methods are described in a dedicated section on the store’s website.

  2. AEON-KĄCIK ZEGARKOWY typically offers the following delivery options:
    • Kurier InPost
    • Paczkomat InPost
    • DHL

  3. Order status updates, order processing times, shipping confirmations, and other information are sent to the customer’s email address or made available on the store’s website.


§4. Proof of Purchase

  1. Proof of purchase is the confirmation of an electronic bank transfer and/or an issued invoice.

  2. Issuing an invoice requires providing complete and correct buyer information.

  3. Requesting an invoice authorizes the seller to issue it without the recipient’s signature.


§5. Complaints (Warranty for Defects)

  1. The seller undertakes to deliver goods that are free from defects.

  2. The seller is liable to consumers under the statutory warranty for defects in accordance with Articles 556–576 of the Polish Civil Code. The statutory warranty is excluded for business customers.

  3. Before sending back an item for complaint handling, the customer must contact the store via email to confirm the return date and method. Proof of purchase must be included. The customer will receive the designated InPost parcel locker address after consultation.

  4. The seller will review the complaint within 14 days. If the complaint lacks required information, the seller may request the customer to supplement it.


§6. Guarantee

  1. Information regarding the guarantee is provided in the product description on the store’s website.

  2. If no separate information is provided, a 24-month guarantee applies.


§7. Right of Withdrawal and Returns

  1. The Customer has the right to withdraw from a distance contract within 14 days from the day of receiving the Product, without giving any reason, subject to the exceptions indicated in this paragraph and in Article 38 of the Consumer Rights Act.

  2. The right of withdrawal does not apply to non-prefabricated products, i.e. products manufactured, assembled or sourced upon the individual request of the Customer, in particular when:

    1. the product is marked on the Store website as “Made to Order” / “On Order”;

    2. the product is not in stock and is sourced from the manufacturer or distributor only after the Customer places an order;

    3. the product is created according to the Customer’s specification, including but not limited to: selection of a specific configuration, set, colour variant, strap, bracelet, or any other component not available in the Store’s standard offer;

    4. the order results in the creation of a custom or non-standard set not available in the Store’s regular assortment.

  3. Products referred to in section 2 cannot be returned, as they are made in response to the individual needs of the Customer and cannot be resold as prefabricated goods within the meaning of Article 38(3) of the Consumer Rights Act.

  4. In the case of withdrawal from a contract which is subject to the right of return, the Customer is liable for any decrease in the value of the Product resulting from handling it in a manner exceeding what is necessary to establish the nature, characteristics, and functioning of the Product.

  5. The costs of returning the Product to the Seller in the event of withdrawal are borne by the Customer. The Customer is also responsible for properly securing and packaging the returned Product for transport.

  6. The right of withdrawal from the contract also does not apply to:

    1. products showing signs of use exceeding what is necessary to establish their nature and functioning;

    2. products damaged by the Customer;

    3. products which, due to their nature, become inseparably connected with other items after delivery.

  7. To exercise the right of withdrawal, the Customer must first submit a withdrawal statement to the Seller — in writing or by electronic means.
    Sending or returning the Product without first submitting a withdrawal statement does not constitute an effective withdrawal and may result in the refusal to accept the shipment.

  8. The Product may be returned only to the return address previously confirmed by the Seller in response to the Customer’s withdrawal statement.
    Sending the Product to any other address, or without receiving confirmation of the return address, does not constitute an effective return and may result in the refusal to accept the shipment.

  9. The Seller shall refund the payments made by the Customer no later than 14 days from receiving both the withdrawal statement and the returned Product, except for situations described in sections 2–8.


§8. Abuse Prevention and Service Limitations

  1. The store reserves the right to refuse further orders from a customer if:
    a) they repeatedly place orders and later cancel them (paid or unpaid),
    b) they abuse the right of withdrawal, causing disproportionate costs to the store,
    c) they place orders in a manner indicating bad faith.

  2. The customer will be notified by email if the store decides to refuse further orders and will be informed of the reasons.


§9. Personal Data

  1. Providing personal data when placing an order constitutes consent for storing and processing the data for the purpose of order fulfillment.

  2. The customer has the right to access, correct, and request deletion of their data from the database.
