Terms and Conditions of the AEON – Watch Corner Online Store

§1. Seller and scope of these Terms

  1. The AEON – Watch Corner online store, operating at aeonzegarki.com, is run by Jarosław Napierała, conducting business under the name AEON – Kącik Zegarkowy, ul. Polska 15a/1, 67-200 Głogów, Poland, Tax Identification Number (NIP): 693-102-48-79, Business Registry Number (REGON): 390372966, e-mail: info@aeonzegarki.com, telephone: +48 514 761 004, hereinafter referred to as the “Seller”.

  2. These Terms govern use of the Store, placement and fulfilment of orders, payments, delivery, complaints, guarantees and withdrawal from distance contracts.

  3. “Customer” means a person placing an order, while “Consumer” means a natural person entering into a legal transaction with a business that is not directly connected with that person’s business or professional activity.

  4. The provisions concerning Consumers also apply, to the extent required by applicable law, to a natural person entering into a contract directly connected with that person’s business activity where the contract is not of a professional nature for that person.

§2. Product presentation, orders and conclusion of contract

  1. Product information presented in the Store constitutes an invitation to submit an offer and not an offer by the Seller within the meaning of the Polish Civil Code.

  2. The Customer submits an offer to conclude a sales contract by adding a product to the shopping cart, providing the information required to fulfil the order, selecting payment and delivery methods and using a button that clearly indicates an obligation to pay.

  3. An automatically generated message confirming receipt of an order confirms only that the order has been registered in the system and does not mean that the Customer’s offer has been accepted.

  4. The sales contract is concluded when the Seller sends the Customer a separate confirmation that the order has been accepted for fulfilment.

  5. Before concluding the contract, the Seller may verify product availability, the accuracy of the information provided, delivery availability, the correctness of the price and the credibility of the payment and order.

  6. Before the contract is concluded, the Seller may refuse an order, in particular where the product is unavailable, the manufacturer or distributor has refused to supply it, delivery to the specified country is impossible, the Customer’s information is incomplete or false, there is an obvious pricing or description error, payment has not been completed successfully or there are objective grounds indicating fraud or unlawful use of data.

  7. Where a paid order is refused, the Seller will promptly inform the Customer and refund the amount received using the same payment method unless another method is agreed with the Customer.

  8. An order that remains unpaid for 48 hours after being placed will be cancelled automatically. Where payment is received after cancellation, the Seller may confirm product availability again or refund the amount received.

  9. The Seller may limit the quantity of a particular product that can be purchased in one order where this results from limited availability, manufacturer rules or the need to prevent speculative resale.

§3. Prices, payments and sales documentation

  1. Prices displayed in the Store are gross prices where applicable law requires them to be presented as such. The final price, currency and all known costs are displayed before the order is placed.

  2. Available payment methods are shown on the “Payment Methods” page and during the ordering process.

  3. The Seller begins fulfilling an order after payment has been received successfully unless expressly agreed otherwise.

  4. The Seller provides the Customer with a bill or another sales document required by applicable law. The document may be provided in paper or electronic form.

  5. If card payment is made available during checkout, the entity providing online payment processing for card transactions is Autopay S.A. Available card payment methods may include Visa, Visa Electron, Mastercard, Mastercard Electronic and Maestro. The payment methods actually available for a particular order are presented to the Customer during checkout.

  6. For card payments, order processing begins after positive payment authorisation has been received. Where a refund is required, the Seller will use the same payment method used by the Consumer, unless the Consumer expressly agrees to another method that does not involve any additional costs.

  7. A bill, order confirmation or payment confirmation is not the only acceptable proof of purchase. The Customer may demonstrate the purchase by other reliable means.

§4. Delivery

  1. The Store delivers within Poland and to selected countries. Available destinations and delivery methods are displayed in the shopping cart or agreed with the Seller.

  2. Delivery within Poland and the European Union is free of charge unless a particular offer or delivery method expressly states otherwise.

  3. Available delivery methods include, in particular, InPost courier delivery, InPost Parcel Lockers and DHL. Availability may depend on the country, type of product, order value and current carrier services.

  4. The estimated fulfilment time is stated on the product page. For models sourced from a manufacturer or distributor, the period may change for reasons beyond the Seller’s control, including supplier delay, customs clearance or temporary unavailability. The Seller will inform the Customer of any material delay.

  5. The Customer must provide a correct and complete delivery address. Where delivery fails for reasons attributable to the Customer, including an incorrect address or failure to collect the parcel, the Seller may require payment of the actual cost of reshipping.

  6. For delivery outside the European Union, the Customer may be required to pay customs duties, import taxes or other charges imposed in the destination country unless expressly stated otherwise.

  7. Where a parcel is visibly damaged, the Customer is advised to take photographs and prepare a damage report. Failure to prepare a report does not remove a Consumer’s statutory rights but may make it more difficult to establish the carrier’s liability.

§5. Consumer complaints – lack of conformity with the contract

  1. The Seller is liable to the Consumer for lack of conformity of goods with the contract under Article 43a and the following provisions of the Polish Consumer Rights Act.

  2. As a general rule, the Seller’s liability lasts for two years from delivery of the goods unless applicable law or a binding public statement provides for a longer period.

  3. The Consumer may demand repair or replacement. The Seller may replace the goods instead of repairing them, or repair them instead of replacing them, where the method selected by the Consumer is impossible or would involve excessive costs compared with the alternative method.

  4. Where both repair and replacement are impossible or would involve excessive costs, the Seller may refuse to bring the goods into conformity. The Consumer retains the remedies provided by law.

  5. A price reduction or withdrawal from the contract is available only in the circumstances specified by applicable law. The Consumer may not withdraw from the contract where the lack of conformity is minor.

  6. A complaint may be sent to info@aeonzegarki.com or submitted in writing to the Seller’s address. For efficient handling, the Consumer is advised to provide the order number, a description of the issue, the date on which it was identified, the requested remedy and, where possible, photographs or a recording.

  7. The Seller will respond to a Consumer complaint within 14 days of receiving it.

  8. The Consumer must make the goods covered by the complaint available to the Seller. The Seller bears the costs of repair or replacement, including necessary transport, labour and material costs.

  9. The Seller is not liable for a particular characteristic of the goods where the Consumer was specifically informed before the contract was concluded that the characteristic departed from the objective conformity requirements and the Consumer separately and expressly accepted that departure, to the extent permitted by applicable law.

§6. Voluntary three-year Seller warranty

  1. Unless the product page or a separate document states otherwise, watches are covered by a three-year Seller guarantee beginning on the date on which the product is delivered to the Customer.

  2. The guarantee is a voluntary additional entitlement and does not exclude, restrict or suspend the Consumer’s statutory rights arising from lack of conformity of the goods with the contract.

  3. The guarantee covers defects in materials, manufacturing and function that exist in the product or arise during its correct use.

  4. The guarantee does not cover, in particular:

    • normal wear of straps, bracelets, spring bars, batteries, seals, coatings, clasps and other consumable components;
    • scratches, abrasions, dents, broken glass and other mechanical damage;
    • damage caused by impact, dropping, pressure, chemicals, extreme temperatures, strong magnetic fields or improper storage;
    • water ingress or moisture caused by use contrary to the watch’s water-resistance rating, operation of the crown or pushers under water or failure to carry out seal checks required by the manufacturer;
    • unauthorised repairs, regulation, opening of the case or interference by an unauthorised person;
    • timekeeping deviations that remain within the manufacturer’s stated specification for the relevant movement;
    • defects caused by use contrary to the instructions or intended purpose of the product.
  5. The watch guarantee does not cover additional accessories unless the product page or a separate guarantee document expressly states otherwise.

  6. A guarantee claim should be sent to info@aeonzegarki.com and include the order number, a description of the defect and, where possible, photographs or a recording. The product must be made available to the Seller for assessment.

  7. Once the claim has been accepted, the Seller will repair or replace the product depending on the nature of the defect and technical feasibility. Where both remedies are impossible or unreasonable, the Seller may refund the product price or propose another solution accepted by the Customer.

  8. The Seller will perform its guarantee obligations within 30 days of receiving the product. Where repair requires imported parts or transfer of the product to the manufacturer or a specialist service centre, this period may be extended after the Customer is informed of the reason and expected completion date.

§7. Consumer withdrawal from a distance contract

  1. The Consumer may withdraw from the contract without giving a reason within 14 days from the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes possession of the goods.

  2. To meet the deadline, it is sufficient to send the withdrawal statement before the period expires. It may be sent to info@aeonzegarki.com or in writing to the Seller’s address. Use of the model form at the end of these Terms is optional.

  3. The Consumer must return the goods without undue delay and no later than 14 days after withdrawal. The Consumer bears the direct cost of returning the goods.

  4. The Consumer is advised to return the complete set with the box, documents, accessories, bracelet links, complimentary items and protective components supplied with the product. A missing item does not invalidate withdrawal but may affect the value of the returned goods.

  5. The Consumer is liable for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

  6. For watches, handling beyond ordinary examination may include, in particular, wearing the watch beyond the place in which it is tried on, removing protective films combined with signs of use, shortening or permanently adjusting a bracelet, scratching the case, crystal, clasp or bracelet, soiling a strap, activating functions in a way that changes the condition of the product or losing elements of the set.

  7. The Seller may reduce the refund by the actual and demonstrable reduction in the value of the goods. The Consumer will be informed of the basis and amount of the reduction.

  8. The Seller will refund payments received, including the cost of the least expensive standard delivery method offered by the Store, without undue delay and no later than 14 days after receiving the withdrawal statement. The Seller may withhold the refund until the goods are received or the Consumer provides evidence that they have been sent back, whichever occurs first.

  9. The refund will be made using the same payment method unless the Consumer expressly agrees to another method that does not incur any cost.

  10. The right of withdrawal is excluded in the circumstances specified in Article 38 of the Polish Consumer Rights Act, including for non-prefabricated goods manufactured according to the Consumer’s specifications or intended to meet the Consumer’s individual needs.

  11. The mere labelling of a standard product as “Made to order”, the fact that it is not held in stock or its sourcing from a manufacturer or distributor after the order is placed does not exclude the right of withdrawal where the product has not been made according to the Consumer’s specifications or clearly personalised.

§8. Business Customers

  1. This section applies to Customers who are businesses and do not benefit from the protection granted by law to natural persons conducting business activity on consumer terms.

  2. The Seller’s statutory warranty liability towards such Customers is excluded to the fullest extent permitted by law.

  3. A business Customer must inspect the parcel and goods promptly after delivery and report visible shortages or damage without undue delay.

  4. The Seller’s liability towards a business Customer, irrespective of its legal basis, is limited to the net price of the order to which the claim relates. The Seller is not liable for loss of profit, indirect loss or business interruption, except where such a limitation is prohibited by law.

  5. Disputes with a business Customer will be resolved by the court having territorial jurisdiction over the Seller’s registered place of business unless mandatory law provides otherwise.

§9. Security and prevention of abuse

  1. The Seller may apply proportionate technical and organisational measures to protect the Store and Customers against fraud, account takeover, unlawful use of data, cyberattacks and other abuse.

  2. Before a contract is concluded, the Seller may refuse a subsequent order, restrict access to an account or require additional verification where there are objective and documented grounds indicating fraud, automated placement of fictitious orders, repeated failure to pay for orders or unlawful use of data.

  3. Measures taken to prevent abuse do not restrict rights arising from contracts already concluded or a Consumer’s statutory rights.

§10. Personal data

  2. Personal data is processed, in particular, for the purposes of concluding and performing the contract, handling payment and delivery, complying with legal obligations, handling complaints, ensuring security and establishing, pursuing or defending legal claims.

  3. Providing the information necessary to fulfil an order is a condition of concluding and performing the contract and does not constitute marketing consent.

  4. Detailed information about data processing is provided in the Privacy Policy available in the Store.

§11. Services provided electronically

  1. The Seller provides electronic services that include, in particular, browsing the Store’s offer, placing orders, maintaining a Customer account, using forms and – subject to separate consent – receiving the newsletter.

  2. Use of the Store requires a device with Internet access, an up-to-date web browser, an active e-mail address and support for cookies necessary for the Store to operate.

  3. The Customer may not provide unlawful content, attempt to interfere with the operation of the Store or use it in a manner contrary to law or accepted standards of conduct.

  4. The Customer account is maintained free of charge. The Customer may request its deletion, subject to any information that the Seller is required to retain by law or for the protection of legal claims.

  5. Complaints concerning electronic services may be submitted to info@aeonzegarki.com.

§12. Alternative dispute resolution

  1. A Consumer may use out-of-court complaint and redress procedures, including assistance from a municipal or district consumer ombudsman, the Trade Inspection Authority or another competent entity conducting alternative consumer dispute resolution proceedings.

  2. Information about available alternative dispute resolution procedures is published by the Polish Office of Competition and Consumer Protection.

§13. Final provisions

  1. Contracts concluded through the Store are governed by Polish law without depriving the Consumer of protection granted by mandatory provisions applicable in the Consumer’s country of habitual residence.

  2. Amendments to these Terms do not affect acquired rights or the terms of contracts concluded before the amendments enter into force.

  3. Matters not governed by these Terms are subject to applicable law.
